Abstract

The word jihād might be one of the most misinterpreted terms in the history of Islamic legal discourse. However, discussion of the doctrine of jihād as bellum justum cannot easily proceed without first giving a clear definition of this term within its historical context. Therefore, this chapter will examine chronologically the relevant primary sources of both Islamic and public international law.

Keywords: Islamic Law of Nations; Doctrine of Jihad; Theory of Just War; International Humanitarian Law; Belligerent Occupation; International Comparative Law.
