Abstract

This paper considers the Legal implications of the death of Prince Abubakar Audu (the Candidate), the All Progressives Congress’ (APC) candidate in the gubernatorial election held on Saturday, 21 st November, 2015 in Kogi State taking into cognizance the extant laws and decisions of the Supreme Court of Nigeria (the Apex Court), particularly focusing in no particular order on sections 181(1) of the 1999 Constitution of the Federal Republic of Nigeria as amended (the Constitution); sections 141, 33 and 36 of the Electoral Act, 2010 as amended (the Act); and the Pronouncements of the Apex Court in the cases of P.D.P. v. I.N.E.C. and Amaechi v. I.N.E.C. with a view to ascertaining whether our extant laws or Judicial Authorities have adequately addressed the emerging legal issues given the divergence of opinions emanating from legal pundits.
