Abstract

Russian Abstract: Свершилось: под занавес пленум ВАС РФ принял эпохальное постановление о свободе договора. Проблема, касающаяся определения того, диспозитивной или императивной является норма закона, регулирующая договорные отношения, являлась одной из самых спорных. Без ее решения презумпция императивности любой нормы гражданско-правового закона так бы и продолжала сопровождать любую сделку, словно стервятник, кружащий над умирающей жертвой. К сожалению, риски подобной презумпции, а именно последующее аннулирование сделки, так и не были поняты разработчиками поправок в ГК РФ.

English Abstract: It's official: at the last moment the Plenum of the Supreme Arbitration Court of the Russian Federation adopted the regulation on the contract freedom. This issue concerning the mandatory and non-mandatory nature of provision of law which controls contractual arrangements, is one of the most disputable and controversial. As vulture straying about the goner, the presumption of mandatory nature of law provision would have continued to follow any transaction without the solution of before-mentioned issue. Unfortunately, the risks of presumption, namely the subsequent cancellation of transaction, had not been taken into consideration by the developers of amendments in the Civil Code of the Russian Federation.
