Abstract

French Abstract: S’il est vrais que les civilisations suivent des matrices historiques et traversent des cycles presque biologiques, ce qui expliquerait le déclin des empires fleurissants comme l’Empire Roman ou l’Egypte des pharaons (naissance – évolution jusqu’au plus haut niveau–disparition), on pourrait accepter qu’un phénomène similaire affecte les marques. Si leur moment de succès maximum et popularité fortement répandu n’est pas dirigé avec caution par leur titulaire, cette célébrité peut leur être fatale, attirant une conséquence fortement ressentie par leur titulaire – la dégénérescence.

English Abstract: If we agree that civilisations follow historical patterns and cross almost biological life-cycles, issue that would explain the fall of great empires such as the Roman Empire or the Egypt of pharaons, then we could accept that a similar phenomenon is bound to endanger trademarks. If their period of great success and extended popularity is not carefully managed by their owner, this notoriety may be extremely pernicious, as it may attract an undesired consequence, with negative effects for the owner - their fall in the public domain. This means that the trademark will no longer individualise the products and the services provided by their owner, as in the public perception, the name of the trademark shall equal the product itself.
