German Abstract: Die Wahl unterschiedlicher Anknüpfungspunkte im jeweiligen nationalen IPR kann zu hinkenden Rechtsverhältnissen führen. Darin liegt die Herausforderung für das Unionsrecht und den darin enthaltenen subjektiven Freiheits- und Gleichheitsrechten der privaten Akteure in der Union.
English Abstract: The existence of differing connecting factors in the conflict of law rules within the EU member states might cause "limping" legal relationships. That is challenging the promise of mutual acceptance given by primary EU law. The CJEU has answered by developing and applying the principle of recognition in status (name) and corporate cases. This paper analyzes this development and its ramifications on the classical approach in conflict of laws.
