Abstract

We propose an index that measures the relative degree of coalition voting by Justices on different supreme courts in tightly split opinions, an index of fluidity of judicial coalitions. We compute the index for the 1946 to 2014 period of the U.S. Supreme Court and one period of the Indiana Supreme Court and discuss the results.
