Les aspects juridiques de la protection de l'environnement de la mer Caspienne (Environmental Protection of the Caspian Sea: Legal Issues)

French Abstract:(Après l'éclatement de l'Union des républiques socialistes soviétiques, la Caspienne, le plus grand lac de la planète est devenue le centre d'un débat régional, voire international. L'émergence de nouveaux États riverains de la mer Caspienne dans la société internationale pose le problème du statut juridique de cette zone. Depuis plusieurs années, le statut juridique de la mer Caspienne était défini par les traités de 1921 et celui de 1940, signés par les deux États riverains , l'Union Soviétique et la Perse, puis l'Iran. Mais, l'émergence de nouveaux États riverains de la mer Caspienne - l'Azerbaïdjan, le Kazakhstan et le Turkménistan - et, en particulier, après la connaissance des possibilités d'une exploitation offshore des ressources pétrolières importantes a mis en question ce statu quo. L'incertitude du régime juridique de la mer Caspienne et les préoccupations et négociations entres les États concernés pour la délimitation des ressources naturelles ont obéré la priorité de protection de l'environnement de la mer Caspienne.)

English Abstract: After the dissolution of the Soviet Union (USSR), the Caspian Sea, the largest lake in the world, became a center of the regional and worldwide debates. In fact, the emergence of the new states in the international society bordering the Caspian Sea evoked the problem concerning the legal status of this body of water. Historically, for several years, the legal status of the Caspian Sea was defined by the treaties of 1921 and 1940, signed by the two littorals States: the Soviet Union and Persia (Iran). However, the emergence of the new states bordering the Caspian - Azerbaijan, Kazakhstan and Turkmenistan - and in particular after the knowledge of the possibilities of an offshore exploitation of oil resources has challenged this status quo. In this perspective, the uncertainties of the legal regime of the Caspian Sea and hard negotiations among these States for the delimitation of natural resources have ignored the environmental protection priority. This study analyzed the environmental problems in the Caspian Sea region.
