La Segregación Procesal Penal Como Desafío Para La Justicia Transicional Chilena (The Segregated Use of the Chilean Criminal Procedure As a Challenge for Its Transitional Justice)

Abstract

Spanish Abstract: La transición chilena ha incluido el juzgamiento de personas involucradas en los graves crímenes cometidos durante la reciente dictadura chilena. Este proceso se ha llevado a cabo según la antigua justicia procesal penal, de corte inquisitivo, a pesar de que la generalidad de los crímenes cometidos en Chile son, actualmente, perseguidos según un nuevo sistema de corte acusatorio. Este último reemplazó al antiguo procedimiento penal, cual era considerado por la generalidad de la doctrina como contrario a los principios de un Estado democrático. En efecto, este procedimiento penal vulnera el debido proceso, así como otros derechos establecidos en la Convención Americana de Derechos Humanos. Además, el hecho de que este procedimiento se aplique casi exclusivamente a militares constituiría una discriminación indirecta (diferencia basada en una norma objetiva, pero que tiene un impacto desproporcionado en una categoría específica de personas). Esta segregación procesal penal constituye el desafío actual más importante de la justicia transicional chilena, pues su mantenimiento afectará el prestigio de los procesos sobre derechos humanos.

English Abstract: The Chilean transition process has included the judging of those involved in serious crimes committed during the recent dictatorship. These proceedings are carried out according to the old inquisitorial system of criminal procedure. This happens in spite of the fact that almost all crimes committed in Chile are currently judged according to the new adversarial criminal procedure. The latter procedure replaced the former, because there was a broad consensus among scholars that the inquisitorial procedure was against the principles of a democratic State. In fact, the inquisitorial procedure violated due process, together with other rights enshrined in the American Convention on Human Rights. The old procedure is applied almost exclusively to members of the military, which would amount to an indirect discrimination (a differentiation based on an objective rule, but that has a disproportionate impact on a specific category of people). This procedural segregation constitutes the most important challenge to the Chilean transitional process, because its existence will affect the prestige of human rights proceedings.
