Abstract

Urdu Abstract قیاس اور خبرواحد کے متعارض ہونے کی صورت میں کیا طرزِ عمل اختیار کیا جائے گا، اس سلسلہ میں امام ابوحنیفہؒ اور ان کے اصحاب و تلامذہ کی فقہی آراء کو مدنظر رکھتے ہوئے بعد کے حنفی فقہاء اور اصولیوں نے دو مختلف نقطۂ نظر اختیار کیے ہیں۔ ایک یہ کہ راوی اگر قلیل الفقہ یا غیر فقیہ ہو تو اس کی روایت کو قیاس کے مقابلہ میں رد کر دیا جائے گا اور دوسرا نقطۂ نظر یہ ہے کہ روایت اگر بقیہ شرائط صحت پر پورا اترتی ہو تو اسے کسی طور بھی رد نہیں کیا جائے گا، بلکہ اس کے معارض قیاس کو رد کر دیا جائے گا۔ اس تحقیق میں مقالہ نگار اس نتیجہ پر پہنچا ہے کہ امام ابوحنیفہؒ اور صاحبین کا اس سلسلہ میں وہی نقطۂ نظر ہے جو مؤخر الذکر ہے۔

English Abstract In accepting or rejecting the Prophetic traditions, especially the legal ones, Hanafi jurists had strictly followed specific criteria set by their founding fathers, however, some late ‘Iraqi jurists such as ‘Isa b. Aban, Al-Karkhi and Abu Bakr al-Jassas, quoting and depending on the opinions of ‘Isa b. Aban, had added a number of rules to the said criteria which led to a debate in and outside Hanafi school of Islamic law. One of them is the following rule, "a Hadith reported by a companion of the Prophet (peace be upon him) who is considered as “qalil al-fiqh” (lacking juristic expertise) can be classified as unacceptable if it conflicts with analogical reasoning."

In this article, as a case study, the author has analyzed this rule and reached the conclusion that this specific rule had been introduced and added by ‘Isa b. Aban into the legacy of Abu Hanifah and through Al-Jassas who borrowed and advocated Aban’s understanding in the matter under question, a number of leading Hanafi scholars incorporated this viewpoint in their writings, however, in fact it is not stemmed back to the founders of the school. On contrary, there are a lot of examples in their (founders') writings which most likely did not align with the understanding of Isan b. Aban.
