Abstract

Victims and witnesses play a crucial role in the prosecution of acts of sexual violence committed during armed conflict. As witnesses, the trial chambers rely on heavily on their testimonies to establish the liability of the accused. Their cooperation is thus imperative to the prosecution process. Under the Rome Statute establishing the International Criminal Court, victims can participate as parties in the trial process. To secure the fundamental role played by victims and witnesses, protective measures have been put in place owing to the numerous threats posed to them. This paper discusses the protective mechanisms adopted by the tribunals as well as the participation of victims during trial. Finally, the various reparation mechanisms available to the victims upon conviction of the accused are discussed.
