Abstract

The paper examines the case law of the boards of appeal of the European Patent Office on procedural aspects of appeal proceedings. It in particular elaborates on the role and function of the Rules of Procedure of the Boards of Appeal and shows their impact on decisions of the boards. The chapter thus takes a procedural angle on the question of how IP law is applied on a European level.
