Italian Abstract: Come può spiegarsi l'ascesa della teologia morale come fonte di pincipi giuridici nel tardo 16. sec.? Il presente saggio cerca una spiegazione nei mutati confini che i giuristi del tempo ridisegnarono tra diritto canonico, diritto civile e teologia morale. Il saggio è basato sui lavori di un canonista, un civilista ed un teologo che condivisero l'atmosfera intellettuale dell'Università di Perugia tra 16. e 17. secolo: Giovan Paolo Lancellotti, Paolo Comitoli and Benincasio Benincasa.

English Abstract: Why did moral theology become so important as a source of legal principles in the late 16th century? This paper argues that the profound transformation which marked legal science during the Counter reformation can be studied looking at how jurists rewrote the boundaries between canon law, civil law, and moral theology.

This paper focuses on the works of three jurists — a civilian, a canonist and a theologian — who shared the intellectual atmosphere of the university of Perugia between 16th and 17th century: Giovan Paolo Lancellotti, Paolo Comitoli, and Benincasio Benincasa.
