Abstract

The federal Alcohol and Tobacco Tax and Trade Bureau has proposed a rule to eliminate the intrastate sales exemption for wine labeling that includes an "appellation of origin." The rule would result in all wines using an appellation of origin in labeling and advertising to be fully finished and bottled in the same state where the grapes used to make the wine are grown. This Comment Letter addresses the First Amendment problem with the proposed rule --- that it cannot withstand scrutiny under the Central Hudson test for commercial speech.
