Indian Refugee Law: Issues and Concerns

Abstract

India has dealt with the issue of ‘refugees’ only on a bilateral basis. Refugees are treated as ‘foreigners’ and are extended protection under the existing Indian laws, which are otherwise also applicable to all foreigners. In the absence of exact refugee law, the question as to who is a refugee becomes more complex. This paper throws light on the historical background of refugee culture in India and the legal rights concerning the protection of refugees. The paper also tries to analyse the problems confronted by refugees, the challenges before the Government and proposes balanced resolutions.
