German Abstract: Die These des Beitrags lautet, dass die Ausweitung des Anwendungsbereichs zentraler Materien des Wirtschaftsrechts Ausdruck und weiterer Treiber einer generellen Ökonomisierung der Gesellschaft ist. Hierbei handelt es sich um die Generalisierung ökonomischer, effizienzorientierter Denk- und Handlungsmuster zu einem Analyse- und Bewertungsprinzip für sämtliche sozialen Beziehungen. Zur Überprüfung dieser These sollen die Grenzen des Anwendungsbereichs des Marktverhaltens- und Unternehmens-rechts abgeschritten werden. Die kritisch-normative Pointe geht dahin, vom Wirtschaftsrecht mehr Reflexivität zu verlangen: Es muss die nicht genuin ökonomischen Gründe für die Begrenztheit seines Regulierungsanspruchs in seine Tatbestandsvoraussetzungen integrieren.

English Abstract: The article addresses the relationship between commercial law and the economization of society. Economization is a process by which economic, efficiency-oriented thinking extends to ever more aspects of the lifeworld. The main point of the article is that the openly defined scope of application of core areas of commercial law allows the economization of society to be transposed into the legal system, which in turn stabilizes economization. Starting with the example of whether advertisements for charitable donations can be considered “commercial practices”, which are thus subject to unfair competition law, the article addresses the object-, subject- and conduct-related limits of the applicability of EU and German commercial law. It demonstrates that EU and German law define the notions of goods and services, of enterprises, and of commercial practices in such a broad and flexible way that more and more objects, actors and acts can be, and indeed are, normatively assessed through the lens of commercial law and thus legal-economic thinking. The article concludes with the claim that commercial law should develop a more self-reflexive attitude in the sense that non-economic considerations should form part of the test for whether commercial law applies to a particular set of facts or whether other areas of private and public law are better suited to pay due respect to the non-economic aspects of the case.
