French Abstract: La règle générale du conflit des lois pour déterminer le droit applicable à un contrat en droit européen et en droit turc qui suit la Convention de Rome est, en l'absence du choix de la loi applicable est le droit de la parties qui fournit la prestation caractéristique. L'application directe de cette règle n'apparaît pas convenable pour les contrats de construction. Cet article propose une méthode pour une meilleure solution dans la spécificité des contrats de construction.

English Abstract: Under the European law instruments Rome Convention and Rome I Regulation, as well as the Turkish Private International Law Act - which follows the Rome Convention - which provide for conflict of laws rules for contractual relations, the general rule is to apply the law of the person who shall perform the characteristic performance. The direct application of this rule does not, however, seem adequate in case of construction contracts. This paper discusses the methods to find a better solution in the specificity of construction contracts.
