Abstract
This is a review article of Arthur Ripstein's 'Private Wrongs'. It first presents a critical overview of the book's central themes. The article then argues:
(1) that Ripstein's rationale for a negligence standard is problematic;
(2) that his analysis of nonfeasance and necessity cases needs modification; and
(3) it questions the theoretical foundations of his account of rights.
