Abstract

Alexander Hamilton’s defense of the 1794 Jay Treaty contains parallels to contemporary arguments concerning the investment chapter of treaties like the Trans-Pacific Partnership, a treaty that the Trump Administration appears to oppose. This essay surveys Hamilton’s rationales for protecting the interests of foreign investors.
