Comentário às disposições introdutórias da Lei n.º 67/2007, de 31 de Dezembro (Commentary on the Introductory Provisions of the Law 67/2007, December 31)

Abstract

Portuguese Abstract: Como se refere no prefácio, a Faculdade de Direito da Universidade Católica – tanto a Escola de Lisboa como a Escola do Porto –, na sua unidade de múltiplos docentes, assumiu o desafio de elaborar comentários a leis fundamentais do nosso ordenamento jurídico. Este é o primeiro resultado desse desafio – Comentário à Lei da Responsabilidade Civil Extracontratual dos poderes públicos. A escolha do Regime da Responsabilidade Civil Extracontratual do Estado e demais Entidades Públicas para ser comentado por um conjunto diversificado de docentes de Direito público da Faculdade foi consensual. O caráter fundamental e a atualidade da matéria no nosso Estado de Direito e a sedução que o tema tem exercido na doutrina justificam-na. Cumprido o desafio, esperamos que os destinatários do texto possam sentir os benefícios do trabalho realizado.

English Abstract: As mentioned in the preface, the Faculty of Law of the Catholic University - both the Lisbon School and the Oporto School -, in its multi-teacher unit, took up the challenge of elaborating on the fundamental laws of our legal system. This is the first result of this challenge - Commentary on the Law on the Noncontractual Civil Liability of the State and other Public Bodies. The fundamental character, the actuality of the matter in our Rule of Law and the seduction that the subject has exerted in the doctrine justifys it. Meeting this challenge, we hope that the recipients of the text can feel the benefits of the work done.
