A Dignidade da Pessoa Humana e o Direito à Saúde - Políticas Públicas e Ativismo Judicial (Human Dignity and the Right to Health - Public Policies and Judicial Activism)

Abstract

Portuguese Abstract: Se é verdade que a generalidade dos direitos fundamentais são projeções mais ou menos nítidas da dignidade da pessoa humana, também é verdade que o direito à saúde é um dos direitos fundamentais em que mais cristalinamente se descortina uma relação umbilical com o princípio da dignidade da pessoa humana. Num domínio onde não pode deixar de existir uma certa insatisfação na realização deste direito, a pergunta a fazer é a de saber se compete ao poder judicial a tutela dos direitos sociais perante a inércia ou deficiência da atividade político-legislativa. O ativismo judicial em matéria do direito à saúde será um exercício de paternalismo judicial ou uma genuína violação do princípio da separação de poderes?

English Abstract: If it is true that most fundamental rights are somehow projections of human dignity, it is also true that the right to health is one of the fundamental rights in which we can transparently discover an umbilical relationship with the principle of human dignity. In a context where there is always certain dissatisfaction in the realization of this right, the question to ask is whether it is for the judiciary to protect social rights as reaction to the inaction or insufficient commitment of the legislator. Is it judicial activism towards the right to health an exercise of judicial paternalism or a genuine violation of the principle of separation of powers?
