Abstract

In this short report, we consider some of the intellectual property (IP) law concerns arising from the creation and use of machine-readable physical markers that link to creative content called Artcodes. We begin by outlining what Artcodes are before turning to key IP issues they present. Specifically, we will look at practical dimensions of copyright law, design rights, and trademark protections in relation to the Artcodes and associated creative works; the technical infrastructure for creation of Artcodes (particularly the Artcodes mobile app); the Artcode experiences, particularly IP concerns with linking Artcodes to third party creative content.
