Cross-Border Placement of Children within the European Judicial Space: First Thoughts on the Recast Brussels IIa Regulation in Light of the German Experience

Abstract

The first part of the present work investigates legal and practical problems emerged in the German legal system concerning cross-border placements of children under art. 56 Brussels IIa Regulation. The second part of the work offers a first critical assessment of the changes proposed to the Brussels IIa Regulation, and highlights problems that might still occur should the new rules enter into force as they are proposed.
