Is Stamp Duty Payable for Work Orders?

It is a common notion that only formal agreements are liable for stamp duty and that work orders do not attract stamp duty. This short paper addresses the issue. The paper focuses specifically on the law as prevailing in the State of Tamil Nadu but is applicable to all the states where there are similar provisions. The paper argues that a Work Order attracts stamp duty under the Indian Stamp Act, 1899, as applicable to Tamil Nadu. Therefore, contracting parties would do well to make arrangements to pay the appropriate stamp duty, failing which such instruments could be liable for disabilities and penalties provided for under the said law.
