Abstract

French Abstract: Le droit local, laissé en vigueur par l’Empire Tzariste après l’annexion en 1812 de la Bessarabie, comprends le Hexabible de Harmenopoulos (1345) et le Manuel d’Alexandre Donitch (1814). Dans une occurrence où le frère du testateur mettait en cause la validité du testament disposant en grande partie en faveur de la concubine du decujus, la Cour d’Appel de Chişinău a fait en 1925 application des lois ci-dessus, en expliquant leur sens par une belle analyse de droit romain. Notre article envisage la cohérence de cette analyse.

English Abstract: The aboriginal Romanian law, left as it was by the Russian Empire after the 1812 annexion of Bassarabia, included the Hexabiblos of Constantine Harmenopoulos (1345) and the Manual of Alexandru Donici (1814). In a case brought up before the judges, the brother of the deceased alleged the voidance of the will designed to give everything to the concubine of the later. The Chişinău's Court of Appeal decided in 1925 based on the above mentioned codes and by making a wonderful Roman Law analysis. Our article gives a critical overlook of this analysis.
