Abstract

The Law Society's inquiry into Advertising & Fee Arrangements is timely and welcome. The Working Group Report of June 23, 2016 provides a perceptive analysis of the status quo as well as a series of sensible suggestions. The premise of this submission is that regulation should seek to maximize the interests of consumers and would-be consumers of legal services. Consumer interests here, as elsewhere, are in (i) high service quality, (ii) low and fair service price, and (iii) broad and informed choice among alternative services. Adopting this consumer interests framework is the best way to promote the reputation of the legal profession in the long run.

Drawing on and responding to the Working Report, this document will make submissions regarding three issues: 1. Fees & Disbursements; 2. Referral Fees, and 3. Advertising.
