Portuguese Abstract: A tripartição de poderes é um modelo já amplamente discutido, para fins de funcionamento de instituições públicas e tutela de direitos. No entanto, recentes eventos nacionais e estrangeiros vêm mudando a dinâmica entre os Poderes e demandando uma abordagem nova e interdisciplinar que promova melhor compreensão sobre o assunto. A Teoria da Tripartição Esférica supre esta demanda e explica de que forma o princípio da tripartição de Poderes é, atualmente, aplicado. Esta teoria utiliza uma abordagem normativa, prática e sistemática para analisar diferentes arranjos institucionais e recentes eventos da política nacional e internacional, com a finalidade de explorar a interação entre direito e política. A conclusão inferida deste artigo é que este modelo institucionalizou o poder por meio de mecanismos de controle, mas, também, trouxe uma nova forma de política. A interação entre direito e política segue uma dinâmica determinada, embora os resultados concretos desta interação variem conforme fatores culturais e institucionais de cada sistema jurídico. Este artigo apresenta a teoria supracitada, focando na experiência constitucional brasileira e no funcionamento do Supremo Tribunal Federal.

English Abstract: The separation of powers is a widely debated model, in regard to the due functioning of public institutions and to protection of rights. However, recent national and foreign events are changing the relation between the constitutional branches and demanding a new and interdisciplinary approach in view of a better understanding. The Spherical Tripartition Theory serves this very purpose and explains how the separation of powers principle is applied nowadays. This theory uses a normative, practical and systematic approach to analyze different institutional frameworks and recent events in national and international politics, in order to explore the interaction between law and politics. The conclusion hereby achieved is that this model institutionalized sovereign power through mechanisms of accountability, but, also, brought a new form of politics. The interaction between law and politics follows a certain dynamic, although the concrete outcomes of such interaction vary according to the cultural and institutional singularities of each legal system. This paper presents the aforementioned theory, focusing on the constitutional experience in Brazil and the Brazilian Supreme Court’s performance.
