Abstract

Parents have brought a wave of lawsuits against the sperm bank that's alleged to have misrepresented the criminal, educational, and mental health history of a donor used to conceive 36 children. This article discusses this novel litigation in the context of legal protections in the United States and abroad. It incorporates insights from an interview with Professor Dov Fox, whose article entitled “Reproductive Negligence,” 117 Columbia Law Review 149 (2017) elaborates on the significance of wrongdoing that imposes, deprives, and confounds procreation.

Keywords: fertility clinics, litigation, negligence
