Abstract
This paper analyses one form of protection of religious freedom in Australia - provisions in discrimination laws which balance the right to religious freedom with the right not to be discriminated against. It also reviews one proposal for recognising same sex marriage in Australia, and how that provides religious freedom balancing, and considers the impact of a clash between State and Federal laws on the issues.
