El Pago del Préstamo Hipotecario Tras el Divorcio (Payment of Mortgage Loan after Divorce)

Abstract

Spanish Abstract: Es un hecho frecuente que cuando se origina una crisis matrimonial, esté vigente el préstamo hipotecario concertado en su día por los esposos para la adquisición de un inmueble (que suele ser la vivienda habitual), suscitándose la cuestión de la proporción en la que los cónyuges divorciados deberán atender a su pago. El Tribunal Supremo se ha pronunciado en varias ocasiones sobre este problema, si bien su doctrina es menos rotunda y clara de lo que se piensa. En el artículo se realiza un análisis crítico de las decisiones judiciales sobre el tema, poniendo de relieve sus inconvenientes y las razones que hacen aconsejable un cambio de criterio, al tiempo que se propone una nueva vía de solución que no coincide tampoco con las formuladas hasta el momento por los autores.

English Abstract: Problems with mortgage loans are particularly common in cases of marital crisis. These mortgages are normally taken out in order to acquire family dwellings. Therefore, after a divorce or a legal separation one of the most controversial points will be to decide the mortgage payment proportions corresponding to each spouse. However, the Spanish Supreme Court doctrine on this subject is neither categorical nor clear. In this paper we take a critical look at these judgments and we propose changing the majority judicial criterion. Also, we bring a new perspective of this problem that may lead us to a new way to solve it.
