Abstract

This article is an update on community benefits agreements (CBAs). It provides practical advice for zoning lawyers in New York regarding the current use of CBAs in New York as well as efforts to require developers to enter into agreements with host communities for certain activities like landfills and wind farm creation. CBAs were first covered in the New York Zoning Law and Practice Report in the context of the Pacific Park/Atlantic Yards development in Brooklyn in November/December 2008. Briefly, CBAs are contracts between a coalition of community groups and a developer where the developer provides a slate of economic benefits in exchange for the coalition not opposing the development project.
