Abstract

Romanian Abstract: Cartea este o parte din proiectul Protecting the Civil Rights of the European Citizens – Multidisciplinary Approach (JUST/2015/JTRA/AG/EJTR/8645) Coordonator: Curtea de Apel Craiova (Romania) și Parteneri Curtea de Apel Suceava (Romania), Fundația Germană pentru Cooperare Judiciară Internaţională – IRZ (Germania) și Tribunalul din Rijeka (Croatia).
Principalul obiectiv al proiectului este acela de a asigura magistraţilor participanţi o pregătire multidisciplinară în domeniul protecţiei drepturilor civile ale cetăţenilor prin prisma celor mai recente instrumente legislative europene adoptate în domeniu.
Proiectul urmăreşte creşterea nivelului de cunoaştere a legislaţiei europene în materia protecţiei drepturilor civile ale cetăţenilor, identificarea eventualelor dificultăţi de ordin practic în procesul de punere în aplicare, dezvoltarea de mecanisme de cooperare eficiente între autorităţile statelor membre ale UE şi prevenirea încălcărilor sub orice formă a liberei circulaţii a cetăţenilor Uniunii Europene, abordate şi din perspectiva sociologiei juridice.
Acesta propune o abordare practică a diferitelor ipostaze ale cooperării judiciare în materie civilă cu incidenţă transfrontalieră, abordare care să transpună concret dispoziţiile teoretice în realitate şi crearea premiselor stabilirii unei jurisprudenţe europene comune generată de punerea în aplicare şi executarea măsurilor de protecţie în materie civilă cu implicaţii transfrontaliere prevăzute de Regulamentul (UE) nr. 606/2013.
Conținut: Rolul şi obiectivele Regulamentului (UE) nr. 606/2013; Cadrul legal european cuprinzând: Regulamentul (UE) nr. 606/2013 al Parlamentului European şi al Consiliului privind recunoaşterea reciprocă a măsurilor de protecţie în materie civilă, adoptat la Strasbourg la 12 iunie 2013; Directiva 2004/38/CE a Parlamentului European şi a Consiliului din 29 aprilie 2004 privind dreptul la liberă circulaţie şi şedere pe teritoriul statelor membre pentru cetăţenii Uniunii şi membrii familiilor acestora, de modificare a Regulamentului (CEE) nr. 1612/68 şi de abrogare a
Directivelor 64/221/CEE, 68/360/CEE, 72/194/CEE, 73/148/CEE, 75/34/CEE, 75/35/CEE, 90/364/CEE, 90/365/CEE şi 93/96/CEE; Carta drepturilor fundamentale a Uniunii Europene; Recunoaşterea şi executarea ordinelor de protecţie în Uniunea Europeană. English Abstract: The key objective of the project is to provide the participating magistrates with a multi-disciplinary training in the area of protection of civil rights for citizens through the perspective of the most recent European legislative instruments adopted in this field.

The project aims to improve knowledge on European legislation in the matters concerning the protection of civil rights for European citizens, to identify potential practical difficulties in the implementation process, to develop efficient cooperation mechanisms among the authorities of EU Member States and to prevent any infringements of the free movement of European Union citizens, aims which are also tackled from the perspective of legal sociology.

The project submits a practical approach to the various examples of judicial cooperation in civil matters with a cross-border dimension, an approach that should specifically translate the theoretical provisions of the law into reality and should build up the pre-requisites for a common European case law resulting from the implementation and enforcement of protection measures in civil matters with cross-border implications as stipulated by (EU) Regulation no. 606/2013.

The content: Role and objectives of Regulation (EU) no. 606/2013; European legal framework comprised of: Regulation (EU) no. 606/2013 of the European Parliament and of the Council on mutual recognition of protection measures in civil matters, adopted at Strasbourg on 12 June 2013; Directive 2004/38/CE of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC; Charter of Fundamental Rights of the European Union; Recognition and enforcement of protection orders in the European Union. Judicial practice in the matter in the European Union; Applicability of Regulation (EU) no. 606/2013 in the context of Regulations Brussels Ia and Brussels IIa; Cooperation between the national judge and the CJEU in the consistent interpretation and application of Regulation (EU) no. 606/2013; Summary references in sociology.
