Inversiones internacionales y corrupción en América Latina: La función del arbitraje de inversiones en el avance de la institucionalidad democrática (International Investments and Corruption in Latin America: The Role of Investment Arbitration in the Advancement of Democracy)

Abstract

Spanish Abstract: Este trabajo expone cómo en la región latinoamericana confluyen los esfuerzos anticorrupción de agentes muy diversos. Adicionalmente, el presente estudio analiza la actitud que hasta el momento ha adoptado el arbitraje de inversiones respecto de la corrupción internacional. El objetivo final de dicho análisis es presentar de forma argumentada una serie de propuestas jurídicas que hagan del arbitraje de inversiones una herramienta más eficaz en la lucha contra la corrupción en Latinoamérica. Dichas propuestas podrían ser tenidas en cuenta tanto en el proceso de reforma iniciado por CIADI como en la creación del tribunal multilateral de inversiones que la Unión Europea propone. Al ir desgranándose todo este análisis, el hilo conductor del derecho económico internacional se va entrecruzando con diversas hebras pertenecientes a la esfera del Ius Constitutionale Commune en América Latina.

English Abstract: This paper firstly shows how the anti-corruption efforts of very diverse agents converge in the Latin American region. In addition, the present study identifies the attitude that has so far been adopted by investment arbitration regarding international corruption. Finally, a series of legal proposals are presented that make investment arbitration a more effective tool in the fight against corruption. These proposals may be taken into account both in the reform process initiated by ICSID and in the creation of the multilateral investment court (MIC) proposed by the European Union. As the paper demonstrates, the guiding thread of international economic law is intertwined with diverse threads belonging to the sphere of the Ius Constitutionale Commune in Latin America.
