Abstract

Spanish Abstract: El presente trabajo analiza la pertinencia de la iniciativa legislativa popular en el sistema institucional chileno. Para ello, indagaremos en sus orígenes y en el singular proceso de trasplante que la llevó de sistemas parlamentarios europeos al presidencialismo latinoamericano. Reflexionaremos sobre las consecuencias de este trasplante y la experiencia habida en Latinoamérica. Lo señalado anteriormente, tiene el objetivo de establecer la más óptima manera de canalizar la participación en el proceso legislativo chileno. Esto nos llevará, finalmente, a la opción por otro mecanismo: la iniciativa popular que permite abrogar leyes.

English Abstract: This paper analyzes the relevance of the popular legislative initiative in the Chilean institutional system. For that purpose, we will investigate its origins and the unique process of extrapolation that took it from Europeans parliamentarians systems to Latin American presidentialism. We will deliberate about the consequences of this extrapolation and the experience founded in Latin America. All of the aforementioned has the purpose to establishing the best manner to ensure participation in the Chilean legislative process. This will finally lead us to opt for another mechanism: the popular initiative that allows abrogating laws.
