Abstract

In 2015, the Third Circuit Court of Appeals issued its decision in Zahner v. Secretary of the Pennsylvania Department of Human Services. The decision represents a favorable ruling for elder law attorneys and their clients and suggests approaches that may achieve clients’ Medicaid planning goals. This case note reviews the Zahner decision and its impact on annuities in the context of Medicaid eligibility.
