Danish Abstract: Med afsæt i Højesterets nylige dom i Ajos-sagen viser artiklen, at der fortsat hersker udbredt forvirring om forholdet mellem begrebet folkeretssubjektivitet og diskussionen om dualisme over for monisme. Ideen om en tvungen sammenhæng mellem en folkeretlig norms adressater og dens virkning i national ret hidrører fra en bestemt retsfilosofisk retning, der for længst er forladt. Alligevel indeholder nutidig retsvidenskabelig litteratur og dompraksis en række eksempler på, at opfattelsen af disse to grundlæggende temaer som indbyrdes forbundne tillægges betydning både på det folkeretlige og det nationalretlige plan.
English Abstract: Taking the Danish Supreme Court’s recent judgment in the 'Ajos case' as its point of departure, this article illustrates the ongoing confusion about the relationship between the concept of personality in international law and the debate of monism vs. dualism. The idea of an inherent link between the addressees of an international legal norm and its effect in domestic law originates from a particular school of thought, which has long since been abandoned. Nevertheless, there are numerous examples from contemporary international legal scholarship as well as practice, where the perception of these two fundamental issues as inextricably connected has been attributed weight.
