A Revolution in Child Support: The Aftermath of The Supreme Court Ruling in LFamA 919/15

Abstract

תקציר בעברית: בפסק דין בע"ם 919/15 שינה בית המשפט העליון את הנורמות שנקבעו בפסיקה בנוגע למזונות ילדים מגיל שניתן פה-אחד בידי שבעה שופטים, עורר שאלות בנוגע לאופן יישומו ובשיח הציבורי, כמו גם בפסקי דין שבאו בעקבותיו, התעוררה מחלוקת בנוגע למה שנפסק בו.

כדי להבין את פסק הדין, במאמר זה מציג יואב מזא"ה בקצרה את הדין הדתי ואת השאלה שעמדה בפני בית המשפט. המאמר בוחן את פסק הדין ובמיוחד את עמדותיהם של השופטים פוגלמן וברק-ארז, ומראה את הסינתזה בין עמדותיהם שהובילה לפסק הדין שניתן פה-אחד.

לאור הוויכוח שעורר פסק הדין, מזא"ה עומד על ההבדלים בין מה שמיוחס לפסק הדין לבין מה שנקבע בו באמת, ומציג שתי נוסחות פשוטות ליישום (אחת למשמורת משותפת ואחת למצבים שאינם משמורת משותפת), כפי שעולה מפסק הדין.

English Abstract: In LFamA 919/15, the Israel Supreme Court changed dramatically the norms that had been in place regarding child support for children aged 6 and above. The judgment, which has been unanimously endorsed by seven justices, stirred a debate in the general public, as well as in subsequent cases.

To understand the ruling, Yoav Mazeh briefly describes the Jewish law and the question that came before the Supreme Court. The article examines the ruling, in particular the opinions of Justices Fogelman and Barak-Erez, and shows the synthesis that led to the unanimous decision.

In light of the debate over the ruling, Mazeh demonstrates the differences between what has been wrongly attributed to the ruling and what it truly held, and presents two simple and applicable formulas (one for joint custody, the other for sole custody), as were put forth in the ruling.
