Abstract

Indonesian Abstract: INTISARI Sejalan dengan naluri dasar manusia untuk bersosialisasi, konflik rawan terjadi dalam kehidupan manusia. Kerugian yang ditimbulkan dari konflik tersebut kepada satu sama lain seringkali dapat dinilai dengan uang. Melihat fenomena ini, dikembangkanlah sebuah cabang khusus dalam ilmu hukum yang mengatur tentang hubungan keperdataan dalam masyarakat yaitu hukum perdata. Indonesia termasuk di antara negara-negara yang telah menginstitusionalisasikan hak keperdataan dan mekanisme untuk menyelesaikan perselisihan, karena hal ini sangat terkait dengan hak masyarakat untuk menikmati keadilan dan kepastian hukum. Dengan kajian pustaka, penelitian ini mengambil dasar bahwa hak masyarakat tersebut tergolong sebagai hak asasi manusia. Kemudian dengan menggunakan wawancara dengan narasumber serta survei kepada sejumlah responden sebagai sampel, ditemukan bahwa saat ini terdapat permasalahan dalam penyelesaian sengketa perdata. Permasalahan ini menimbulkan hambatan bagi para pencari keadilan dalam sengketa perdata, baik karena alasan ketidakmampuan finansial maupun karena nilai sengketa tidak sepadan dengan biaya yang dikeluarkan untuk menjalani proses peradilan. Penelitian ini menunjukkan besarnya halangan-halangan tersebut di dalam area tertentu, dan besarnya kebutuhan untuk reformasi sistem hukum perdata untuk lebih mengakomodasi hak-hak asasi tersebut.

English Abstract: Along with the human nature to interact, comes the nature of conflict. Damage and losses maybe inflicted to each other, among which are those measurable by currency. In response to the matter, legal science develops a branch which regulates the private rights of citizens known as the civil law. The Indonesian governments are among those who have institutionalized these private rights and mechanisms to adjudicate conflicts between them, as it also connects with rights of citizens to enjoy justice and certainty of law. This research employs a literature study to discover the existence of these rights as a fundamental human right. Further endeavours are taken with interviews and sampling, highlighting an undelightful phenomenon in our legal system: blindspots. These blindspots result in the lack of ability of the Indonesian law and courts to benefit those who wish to seek justice for their private matters, due to economical conditions or that economical value of the dispute is insignificant in comparison towards the cost of tribunal conducts. This research finds that indeed there are major impediments for citizens to access their rights to justice for matters under civil law in certain areas, which then should consequently be a consideration for a judicial reform with a sole interest of a faithful recognition of human rights.
