On 14 July 2014 a complaint was filed requesting the Prosecutor of the International Criminal Court to initiate an investigation into the crimes committed in the Republic of Cyprus (hereinafter Cyprus) arising from the continued civilian displacement, ethnic cleansing, and settlement activity of the Government of Turkey. In this paper I intend to present the main arguments raised therein. In effect, the complainants submit that the settlement activities of Turkey within the territory of Cyprus, constitute the war crime of directly and indirectly transferring civilian population of an occupying power into occupied territory, in violation of Article 8(2)(b)(viii) of the Rome Statute.
