Abstract

Plaintiffs stated at oral argument that they intend to bring a motion to add individual capacity claims (in addition to the extant official capacity claims) against the President. This lettter suggests that any such novel, newly added individual capacity claim would be prejudicial to the Defendant, futile, or has been waived by the prior deliberate litigation strategy of Plaintiffs. Amici Tillman and Judicial Education Project seek an order providing us (and all other amici) an opportunity to make arguments in response to Plaintiffs' motion and any response by Defendant.
