Abstract

Under current English divorce law, judges have total discretion regarding how to divide the parties’ property. The House of Lords is considering a proposed statute that would enact a marital property equitable distribution system in England and Wales.The editors of the English journal “Family Law” asked me to comment, in light of the American experience with such systems, on issues that might arise under the proposed statute. These are my comments, which appeared in the January 2018 issue.
