Abstract

Russian Abstract: Гражданский кодекс России в статье 130 исходит из того, что недвижимой вещью является не только земельный участок, но и любое строение, возведенное на участке или под ним.

До настоящего времени не утихают споры, что представляет собой здание, возведенное на участке, но не зарегистрированное в реестре - это самостоятельная недвижимая вещь или же оно является составной частью земельного участка. С точки зрения законодательства о регистрации недвижимости регистрация права на здание представляет собой нечто вроде юридического разделения одного объекта - земельного участка и здания - на два.

Но проблема может оказаться сложнее, если изучать ситуацию, при которой участок был застроен лицо, не являющимся его собственником.

В деле Верховного суда России, которое комментируется в статье, речь идет именно о такой ситуации.

English Abstract: The Russian Civil Code provides (in the article 130) that the immovable thing is (beside a plot of land) the building or other structure that is erected on (or under) the surface of land.

It is still the matter of discussions and concerns what the building which is erected on the plot of land but is not registered in the land registry is - a separate immovable property or the part of the land plot. In the terms of the Russian private law the registration of the title to the building can be characterized as a kind of legal division of one immovable thing - a plot of land with the structures on it - into two separate immovable things: a land plot and a building.

But the problem seems to be more complicated in the case when the owner of the plot granted to another person a lease for the specific period of time and the latter has the right to build.

The case of the Russian Supreme Court which is the subject of the commentary demonstrates that scenario.
