Ética, Poder Judicial Y Su Responsabilidad En España: ¿Hay Necesidad Real De Un Código Ético Para La Judicatura? (Ethics, Judicial Power and Your Responsibility in Spain: Is There Real Need for an Ethical Code for the Judiciary?)

Abstract

Spanish Abstract: Reflexiones críticas sobre ética, jueces y la presunta división de poderes. Breve reseña sobre el juzgador injusto, su posible responsabilidad, cambio en el pensamiento ético-jurídico y ciertos inconvenientes de la Administración de Justicia española. Exigencia de una ética jurídica y alusión a ciertas experiencias codificadoras respecto de los jueces(Código Ético de la Magistratura italiana, Código de conducta de los Jueces de EE.UU., Carta Europea del Estatuto del Juez, Estatuto Universal del Juez, Estatuto del Juez Iberoamericano, Principios de Bangalore, etc.). Sobre una ética de mínimos y de máximos y de la eventual obligatoriedad de las disposiciones éticas: La lex artis. Conclusión: Empezar desde la base y cumplir las normas jurídicas para allanar el camino ético.

English Abstract: Critical reflections on ethics, judges and the alleged division of powers. Brief review about the unfair judge, his possible responsibility, change in ethical-legal thinking and certain inconveniences of the Spanish Justice Administration. Requirement of a legal ethics and reference to certain coding experiences with respect to judges (Code of Ethics of the Italian Magistracy, Code of Conduct of Judges of the USA, European Charter of the Statute of the Judge, Universal Statute of the Judge, Statute of the Judge Ibero-American, Principles of Bangalore, etc.). On an ethics of minimums and maximums and the possible obligatory nature of ethical provisions: La lex artis. Conclusion: Start from the base and comply with legal rules to smooth the ethical path.
