Scope of Personality, Celebrity or Image Rights in India in the Light of Landmark Judgement of Justice Puttaswamy’s Case (2017)

Justice Puttaswamy’s judgement on August 24, 2017 almost reversed the status of right to privacy in India. The case has a comprehensive explanation to the evolution of right to privacy in India from the commencement of Constitution to till now. The judgement has established the constitutional status of right to privacy in a commendable way and paved way for the other concomitant rights of right to privacy. Through this the long awaited celebrity, personality or image rights will get recognised and established which was asserted in 1890 itself by Warren and Brandeis as “right to be let alone”. These elite rights are the emerging rights in India which need a right framework. By giving a concrete status to celebrity or personality rights India will certainly move to the next level of civilization where an individual celebrates his/her privacy without any interference but with dignity. This article critically analyses the Justice Puttaswamy judgement to bring out the meaning and scope of the elite rights in near future in India and also explains the theories of John Lock, Justin Huges and Utilitarian principle behind the celebrity, personality or image rights in detail.
