An Evaluation of Tracking Location Data from a Data Protection Law Perspective

This article aims to present a general overview of what location data is and whether such data can be deemed personal and/or sensitive data in accordance with local and foreign personal data protection legislations by providing an in-depth evaluation of several different scenarios and judicial precedents. Since any personally identifiable information can be considered as personal data, data controllers should take all the necessary actions and precautions in order to fulfil certain liabilities, which mainly encompass an obligation to provide information to data subjects and to obtain their consent, to process personal data proportionally and not excessively in light of the purposes of data processing. Furthermore, data subjects should also be aware of the various risks associated with data processing and take the necessary steps to ensure the protection of their own locational privacy.
