Rabels Einfluss auf das CISG und die europäische Kaufrechtentwicklung (Rabel's Influence on the CISG and on the Development of European Sales Law)

Abstract

Deutsche Zusammenfassung: Der Beitrag behandelt den Einfluss Ernst Rabels (1874–1955) auf das Weltkaufrecht, das sog. CISG von 1980. Rabel hatte die Schaffung eines internationalen Einheitskaufrechts angeregt und seine Grundstruktur auf der Grundlage eingehender Rechtsvergleichung bereits entwickelt. Selbst viele Einzelvorschriften des CISG haben Rabels Formulierungen in den frühen Vorschlägen übernommen. Der Beitrag zeigt diese Einflüsse an vielen Beispielen auf, die bis zur Modernisierung des deutschen Schuldrechts (2002) und zur 2015 aufgegebenen Entwicklung eines Gemeinsamen Europäischen Kaufrechts (GEKR) für die EU reichen.

English Abstract: The article examines the influence of Ernst Rabel (1874–1955) on global sales law, the so-called CISG of 1980. Rabel had initiated the creation of an international uniform sales law and had developed its main structure on the basis of an intensive comparative law study. Many individual provisions of the CISG adopted verbal formulations that stem from Rabel's early proposals. The present contribution demonstrates this influence with respect to numerous examples, these reaching all the way up to the modernisation of the German law of obligations (2002) and the EU’s ultimately abandoned development of a Common European Sales Law (CESL) (2015).
