Después de la fragmentación: ICCAL, derechos humanos y arbitraje de inversiones (After Fragmentation: ICCAL, Human Rights and Investment Arbitration)

Abstract

Spanish Abstract: Este paper explora la contribución del Ius Constitutionale Commune en América Latina (ICCAL) al debate sobre la relación entre el arbitraje de inversiones y los derechos humanos. Argumenta que el ICCAL puede proveer una teoría normativa sobre el peso que debe ser reconocido a los regímenes jurídicos que operan en el espacio jurídico latinoamericano, la cual permita ir más allá de la narrativa de la fragmentación y la idea de “conflicto”. Adicionalmente, el ICCAL puede servir como una guía de subsidiariedad en el derecho de protección de inversiones, mediante la cual se defina en qué casos los árbitros internacionales deben tener deferencia hacia las decisiones nacionales y en qué casos no. A través de estas contribuciones se avanza la frontera de posibilidades en la agenda de investigación del ICCAL, poniendo sobre la mesa un “ICCAL reforzado” (un ICCAL ) que considere otros regímenes internacionales (diferentes del Sistema Interamericano de Derechos Humanos) que operan en la región.

English Abstract: This paper explores the contribution of Ius Constitutionale Commune en América Latina (ICCAL) to the ongoing debate on investment arbitration and human rights. It argues that ICCAL may provide a normative theory on the weight to be recognized to the different legal regimes operating in the Latin American legal space, going beyond the narrative of fragmentation and the idea of "conflict". Moreover, ICCAL may provide guidelines in terms of subsidiarity in investment protection law, providing criteria to define the appropriate standard of domestic review of international investment decisions. Through these contributions, ICCAL’s frontier of possibilities in research is pushed further, putting on the table a "reinforced ICCAL" (an ICCAL ) that takes into account other international regimes (different from the Inter-American Human Rights System) that operate in the region.
