Abstract

Spanish Abstract: El artículo estudia el matrimonio en sí mismo, y analiza los elementos constitutivos del sacramento. El Nuevo Mundo fue una palestra donde tuvieron que abordarse aspectos del matrimonio que no se habían prácticamente planteado antes: si era matrimonio el del polígamo, el matrimonio entre consanguíneos o el divorcio. Interesó especialmente definir los aspectos del matrimonio que procedían del derecho natural pues era esencial para discernir si era verdadero el matrimonio de los indios antes de su conversión. Se dará mucha importancia al consentimiento y unida ello, la libertad de ambos cónyuges que chocaba en algunos aspectos con la potestad de los padres.

Se siguió la tradición canónica, pero las novedades indianas exigieron nuevas respuestas aportadas por los canonistas americanos respecto al matrimonio natural y los nuevos problemas indígenas.

English Abstract: The article analyses the constitutive elements of the sacrament of marriage. In the New World, several aspects of marriage had to be addressed that had never been raised before, such as questions regarding polygamous marriage, marriage between blood relatives or divorce. There was also a particular interest in defining which aspects of marriage derived from natural law, as canonists sought to determine whether marriages among Indians before their christianisation should be considered valid. Great importance was attributed to the issue of consent, and consequently also to cases in which both spouses’ freedom of choice conflicted with the authority of their parents.

Whilst canonical tradition was followed, the novelty of the Spanish American Dominions demanded new answers to be developed by Hispanic American canonists regarding natural marriage and new indigenous issues.
