Liberdade religiosa e direitos humanos (Religious Freedom and Human Rights)

Abstract

Portuguese Abstract: Com o intuito de investigar o tema da liberdade religiosa como direito humano, a presente obra reúne trabalhos acadêmicos que, mediante uma abordagem interdisciplinar em áreas de conhecimento das Ciências Humanas, analisam o fenômeno religioso a ser tutelado pelo Estado. Apresentam-se quatro eixos temáticos: Bases Antropológicas e Filosóficas; Sistemas Regionais de Direitos Humanos; Princípios Constitucionais e Liberdade Religiosa; e Laicidade e liberdade: uma análise de casos, cada recorte contendo artigos com objetos específicos e pontos de vista diversos, expressando uma multiplicidade de linhas de pesquisa do livro como um todo - o diferencial da coletânea. Fontes antropológicas, filosóficas, históricas ou jurídicas; dogmáticas, legais ou jurisprudenciais; idênticas, convergentes ou divergentes; encontrar-se-á, a seguir, o substrato teórico que auxiliará na busca por soluções para os ainda atuais conflitos referentes às liberdades religiosas. É este o objetivo primário da obra: não esgotar o objeto, mas, pelo contrário, enriquecer as discussões nos ambientes acadêmicos e públicos, seja numa abordagem quantitativa ou qualitativa, sobre um tema tão significativo para a contemporaneidade.

English Abstract: With the underlying purpose of exploring the issue of religious freedom as a human right, this book is a collection of academic works which take an interdisciplinary approach from the Human Sciences to analyze the phenomenon of religion as requiring protection by the State. The chapters are grouped in four major themes: Anthropological and Philosophical Bases; Regional Systems of Human Rights; Constitutional Principles and Religious Freedom; and Laicity (laicidade) and Freedom: a case study, each section containing articles on specific topics from different points of view, covering a large number of lines of research in the whole book, revealing the absence of a one individual viewpoint across the book as a whole – which is this collection’s distinguishing feature. The sources, which adopt identical, convergent or divergent points of view, are taken from the fields of anthropology, philosophy, history, legal theory, dogma, statutes and case law: it is intended to provide a theoretical foundation facilitating the search for solutions to ever current conflicts pertaining to religious freedoms which are still of interest today. Such is the primary objective of the work: not to exhaust the topic, but rather to enrich discussions in academic and public environments, whether in a quantitative or qualitative approach, to a meaningful topic for the contemporary world.
