Abstract

This is a surreply to Ramsi Woodcock's response article on Adam Mossoff’s essay, Trademark as a Property Right. It argues that Woodcock overlooks potential benefits from legal formalism and neglects the shortcomings of some legal realist techniques, particularly those in law and economics.
