5 Years of Operation 'Car Wash': Revisiting Bid Rigging and Bribery Investigations

This article addresses bid rigging and bribery investigations conducted by the Brazilian antitrust and anti-corruption authorities in the scope of the so called Operation Car Wash (Operação Lava Jato). After summarizing the main issues regarding infringements and penalties, it exposes the dissent between the fining criteria established in the CADE Settlement Guidelines (antitrust agency) and alternative methods. In addition, it presents condensed information about the pecuniary contributions charged by CADE, and fines/indemnification charged by CGU (anti-corruption agency). The article concludes with a few lines about policy changes that could take place as of 2019.
